1. Agreement to Terms
These Terms of Service ("Terms") govern your use of Premium Lobster LLC's services, website, and products. By engaging with our services, you agree to be bound by these Terms in accordance with UAE commercial law and applicable food safety regulations.
2. Company Information
Premium Lobster LLC is a company registered in the United Arab Emirates, engaged in the import and distribution of live Canadian lobster products. Our operations are conducted in compliance with MOCCAE (Ministry of Climate Change and Environment) regulations and HACCP food safety standards.
3. Products and Services
We provide:
- Import and distribution of live Canadian lobster
- Cold-chain logistics and handling
- B2B supply services to hospitality partners
- GCC re-export services
4. Ordering and Delivery
4.1 Order Placement: Orders are placed through our partner portal or direct communication with our sales team. All orders are subject to availability and confirmation.
4.2 Pricing: Prices are quoted in USD or AED and may vary based on market conditions, quantity, and seasonal availability. Spring-caught lobsters (April-May) command premium pricing.
4.3 Delivery: Delivery times are estimates and subject to air freight schedules, customs clearance, and MOCCAE inspection requirements.
4.4 Acceptance: Customers must inspect products upon delivery and report any issues within 2 hours of receipt. Live lobster mortality claims must be documented immediately.
5. Food Safety Compliance
5.1 MOCCAE Compliance: All products are imported in compliance with UAE Ministry of Climate Change and Environment requirements, including health certificates and import permits.
5.2 HACCP Standards: Our operations adhere to Hazard Analysis Critical Control Points principles throughout the supply chain.
5.3 Temperature Control: We maintain strict temperature protocols (2-4°C) for live lobster transport and storage. Partners must maintain appropriate receiving conditions.
6. Payment Terms
6.1 Methods: Payment is accepted via wire transfer to our designated bank account.
6.2 Terms: Payment terms vary by customer agreement. Standard terms require payment before shipment release.
6.3 Currency: Invoices are issued in USD or AED. Exchange rate fluctuations are the customer's responsibility.
7. Partner Portal
Access to our Partner Portal is granted to approved business partners. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
8. Limitation of Liability
To the maximum extent permitted by UAE law, Premium Lobster LLC's liability is limited to the value of the products sold. We are not liable for indirect, consequential, or incidental damages arising from product use or business interruption.
9. Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, flight cancellations, or customs delays.
10. Governing Law
These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be resolved through the courts of Dubai, UAE, unless otherwise agreed in writing.
